Minutes of the Regular Council meeting held on Tuesday, May 10th, 2011 pursuant to notice duly given.

1. Mayor called the meeting to order at 6:00 p.m.
2. Roll call: Mayor Fulton, Ed Young, Roger Reed, John Wittkopf, Al Schreiber, Joe Stiloski, Marlene Zahn, Dick Doeren, Terri Berth, Joe Paluch, Jack Maas and Atty. Calvert. Also present: Jack Mlnarik, John Reed and Linda Belongia Administrator and as recording secretary.
3. Invocation and pledge of allegiance given by Alderperson Paluch.
4. Mayor asked that agenda item 9a be moved before the consent agenda.
Moved by Wittkopf seconded by Schreiber to approve of adjusting the agenda per Mayor’s request.
Motion carried upon verbal voice vote. 10 ayes
5. Moved by Zahn seconded by Schreiber to approve and place on file as typed the Committee of the Whole minutes; Council and any Special Council meetings;
Motion carried upon verbal voice vote. 10 ayes
6. Moved by Doeren seconded by Paluch to approve of the department reports as presented and place on file.
Motion carried upon verbal voice vote. 10 ayes
7. Correspondence/Public Input:
a. Mayor Fulton expressed his appreciation to our Director of Public Service, Robert J. Mommaerts who has done an extraordinary job getting Business 41 designed and bid out; Mayor stated we should be digging dirt soon; doing the work in-house Mayor estimated this saved the city $150,000 and we’re following the time schedule.
b. Lt. John Reed from the Oconto Fire Rescue Department requested permission to use the fire dept for a fundraiser for the Oconto County Area Special Olympics for a car wash and cook out; Police Dept will be assisting; Lt. Reed stated a meter will be put on the hydrant for the water usage;
Maas commended Lt. Reed on this event being a wonderful thing and went on record the city will pick up the tab for the water; Mayor concurred, anything we can do to help Special Olympics is good for the city;
Moved by Zahn seconded by Reed to approve of request of Lt. Reed.
Motion carried upon verbal voice vote. 10 ayes
c. Memo from Kale Proksch, Park & Rec Director on need for Gator for campground; League letter; Correspondence from WPS on proposed rate increases for 2012.
9 a. Discussion/action on Appeal submitted by Chris Augustine regarding conditional use permit for
the Oconto Yacht Club (OYC); Mayor asked for brief comments; Augustine stated the plan
commission never did a sight inspection…has been bad blood between the OYC and Augustine’s
family as neighbors…effects other organizations…checked two other similar clubs Suamico Wind
Jammers and the Green Bay Yacht Club…bothered by precedent it sets; Ed Whealon, OYC stated
last year when the club came to the Plan Commission the OYC property is zoned
recreational…no intention of becoming a campground…you have to be a member of the
OYC…club has made commitment and will stick by what we told the Plan Commission…we’ve
spoken to neighbors and they are willing to come and support the OYC.
Mayor referenced city ordinance 13-1-88 and would like to see council have a public hearing on
this;
Moved by Maas seconded by Doeren to authorize that a public hearing be scheduled on June 14th, 2011 at 5:00 p.m. on the appeal.
Motion carried upon electronically recorded voted. 10 ayes

8. Mayor read aloud Consent Agenda: Approve of closing off Park Lane and part of Spies Road for the Trail Busters for truck pulls 6/10/2011 from 3 p.m. to 12 a.m.; Approve of closing off Huron Avenue from Crivello’s parking lot to Pecor Street for the Bicycle Poker Run on 5/21/2011; Approve of Preliminary Resolution regarding special assessments for Cook Avenue from Charles Street to Evergreen Road and scheduling the public hearing was pulled by Maas; Approve with clarification purchase of 2011 John Deere Gator for the Campground that $6,000 was budgeted for; Approve of purchase of 5 trash cans and 2 benches for the Breakwater Park Marina with remaining contingency funds from the project; (Since meeting on 5/3/2011 $2,000 has been donated for the two benches); With freight cost will be $3,016; Award Contract OC-11-A to Peters Concrete in the amount of $1,531,546.00; Approve of Resolution exempting City of Oconto from County Library Tax; Approve of listing of accts payables for $419,088.30; payroll for $113,108.06 and financial reports as presented; Approve of pay Jim Wolfe, Sr., $.51 per mile for 70 miles retroactive to when he started the city’s surveying in 2011; Approve of request from Oconto Youth Center, Inc for 2nd annual Family Fun Day on 6/4/2011 and closing portion of Huron Avenue between Pecor Street and the Phillip Augustine residence at 112 Huron Avenue to accommodate the activities between 8 a.m. to 3 p.m.; Approve of request from Oconto Elks Lodge 887 to close off Park Street on Thurs., June 9th, 2011 from 3 p.m. to 12 a.m. without interfering with Hi Seas Marina for the tractor pull; Approve of request from Oconto Elks for a Temp Class B license for 6/9/2011 for a tractor pull; Approve of request from Oconto Trail Busters for 6/10/2011 for Harbor Road, City Docks for the Oconto Trail Busters Truck pull; Approve of listing 2011 listing for Alcohol Beverage licenses; Accept resignation of Don Denor from the Board of Review; Approve of appointment by Mayor of Terri Berth to Board of Review and re-appointment of Steve Gering to the Police & Fire Commission.
Moved by Wittkopf seconded by Zahn to approve of the Consent Agenda as read except for the pulling of item 8c.
Motion carried upon electronically recorded vote. 9 ayes 1 no Joe Stiloski

8c. Maas stated there are no curb openings for Graphics Management…shouldn’t they be put in during construction? Mayor stated they will have to pay for when the curbs are cut.
Moved by Maas seconded by Schreiber to approve of Preliminary Resolution regarding special assessments for Cook Avenue from Charles Street to Evergreen Road and scheduling the public hearing.
Motion carried upon electronically recorded vote. 10 ayes

9b. Discussion on removal of footings on former Kelly Pickle Property. Mayor stated our city crew are removing the footings; Maas stated we knew those footings were there and council decided to leave them there at that time; Wittkopf questions why…; Maas stated this is no surprise; Mayor stated the concern at that time was cost to remove, now we are doing this ourselves; Schreiber questioned if they are footings or the basement? Mayor stated these are the footings…just FYI for the council;

9c. Moved b y Doeren seconded by Schreiber to approve of accepting the Safe Routes to School Program and authorize the Mayor to sign the agreement.
Schreiber questioned what are we doing? Wittkopf stated this program for sidewalks is at no cost to city;
Motion carried upon electronically recorded vote. 10 ayes

9d. Moved by Wittkopf seconded by Schreiber to accept recommendation from Wage & Personnel and hire Nancy Drewiske for the part-time cleaning position for city hall.
Motion carried upon electronically recorded vote. 10 ayes

9e. Moved by Wittkopf seconded by Schreiber to approve of an operators license for Rebecca Wiegman.
Motion carried upon electronically recorded vote. 10 ayes

9f. Maas questioned if Mike Trepanier had been contacted to reconsider resigning from the IDC…has been a good asset to the commission; Mayor stated he’s tried; Wittkopf questioned reason for resigning?
Moved b y Schreiber seconded by Reed to accept resignation from Mike Trepanier from the Industrial Development Commission.
Motion carried upon electronically recorded vote. 9 ayes 1 no Maas

10. Moved by Zahn seconded by Wittkopf to adjourn. M/C
