Minutes of the Special Council meeting held on Tuesday, June 16, 2009 at city hall pursuant to notice duly given.

1. Meeting called to order at 5:05 p.m. by Mayor Nerenhausen.

2. Roll call: Mayor Nerenhausen, Ed Young, Lloyd Heier, John Wittkopf, Al Schreiber, Joe Stiloski, Marlene Zahn, Dick Doeren, Tom Fulton, Jim Stiloski and Jack Maas. Atty. Mraz was excused. Also present Linda Belongia, Administrator and as recording secretary and Atty. Jim Kalny.

3. Invocation and pledge of allegiance by Alderperson Doeren.

4. Moved by Heier seconded by Wittkopf to approve of the agenda and addendum as presented.
Motion carried upon verbal voice vote. 10 ayes

5. Public appearances/correspondence: June 15th, 2009 Legislative Bulletin.
a. Mayor provided copy of his Executive Order to extend the hours for the noise ordinance for Copperfest.

6. Mayor stated the council may vote to convene into Closed Session pursuant to notice duly given and as allowed by Wis. Stats. 19.85(1), (c),
(e) and (g) for discussion with legal counsel regarding strategy for the
upcoming union negotiations.
Moved by Zahn seconded by Wittkopf to convene into Closed Session at 5:08 p.m.
Motion carried upon verbal roll call vote. 10 ayes
Closed Session included Atty. Kalny
7. Moved by Zahn seconded by Wittkopf to reconvene into Open Session at 6:10 p.m.
Motion carried upon verbal voice vote. 10 ayes
Atty. Kalny left the meeting.

8. Moved by Maas seconded by Fulton to accept recommendation Finance
and approve of selling Outlot 1 to Eric Schanau for $10,000.00 contingent that
Lamkey Street be vacated; contingent that Mr. Schanau purchase 103 Park
Avenue; contingent that a CSM be done to combine all three lots into one; and
contingent that the renovation of 103 Park Avenue be completed within one year
of the closing with renovation costs totaling at least 50% more than the current
assessed value of this home per city assessment records.

Discussion. Wittkopf questioned if Lamkey is vacated? Mayor stated no, but that
is part of the motion; Joe Stiloski stated by vacating Lamkey he would get
another 33’…city could put a dock there…area is used by kids for
fishing…adjacent property is in foreclosure…50% more is not than
much…opposes selling the property; Schreiber questioned if Lamkey is vacated
he gets….; Mayor he’d be the owner on both sides; Jim Stiloski questioned the
issue of contaminates; Belongia stated we have documentation the issue has
been closed by DNR; Jim Stiloski stated he talked to several people, he is
opposed to selling, people were not aware this is city property…would like to see
city put in docks…against selling; Zahn questioned if advertised for sale? Belongia stated no, referenced selling Liegeois property adjacent to his
Excavating property, that was not advertised;
Motion carried upon verbal roll call vote.
7 ayes 3 no: Joe Stiloski, Marlene Zahn and Jim Stiloski

9. Moved by Heier seconded by Wittkopf to approve of request from Chief Carper on holding National Night Out for the City of Oconto on Tues., August 4, 2009
and allow for the use of the city hall parking lot and a sign advertising the event
placed in the front parking lot.
Motion carried upon verbal voice vote. 10 ayes

10. Moved by Doeren seconded by Maas to amend the motion from the 6/2/09 Council meeting to include in the request for rezoning the property for the
proposed TID No. 4 the KCS property changing the zoning from (IG) General
Industrial to (CH) Highway Commercial.
Motion carried upon verbal voice vote. 10 ayes

11. Moved by Fulton seconded by Zahn to accept recommendation from the Com of the Whole and approve of Mayor’s appointment of David Rosenfeldt, Sr., to the
Americans with Disabilities Compliance Act Committee.
Motion carried upon verbal voice vote. 10 ayes

Addendum:
Discussion on acquisition of the Jerome Brezinski property located along Charles Street, Oconto, WI; Mayor questioned the council, do they still want us to
proceed with negotiation with Brezinski for some of his property for ROW; Mayor
stated Brezinski wants a 20’ strip along the East side of their property which is
adjacent to the former Kelly Pickle site; that would amount to 2.16 acres and
based on an assessed value = $6,883, Brezinski wants this in exchange for his
property that we need for the ROW; Schreiber questioned how much property
are we getting for the 20’ strip he wants? Mayor stated quite a bit less; Wittkopf
questioned where does his property end? Mayor stated at the cul du sac for
Howard Lane;

Moved by Maas seconded by Doeren to authorize the Mayor to proceed with negotiation with Brezinski and bring this back to the Com of the Whole or Council
with a map showing the property we are negotiating on.
Motion carried upon verbal voice vote. 9 ayes 1 no – Joe Stiloski

12. Moved by Heier seconded by Wittkopf to adjourn. M/C
Meeting adjourned at 6:26 p.m.
