Council Minutes

Minutes of the Special Council meeting Tuesday, January 19th, 2010 at city hall pursuant to notice given.

1. Meeting called to order at 6:32 p.m.
2. Roll call: Mayor Nerenhausen, Ed Young, Ken Exferd, John Wittkopf, Al Schreiber, Joe Stiloski, Dick Doeren, Tom Fulton, Jim Stiloski, Jack Maas and Atty. Mraz. Excused: Marlene Zahn. Linda Belongia Administrator also present as recording secretary.
3. Invocation and pledge of allegiance given by Alderperson Young.
4. Moved by Wittkopf seconded by Exferd to approve of the agenda as presented.
Motion carried upon verbal voice vote. 9 ayes
5. No public appearances or correspondence.
6. Discussion on recommendation from Finance to approve of financing to meet the city’s share of the repairs to the existing dock wall. Also present for the discussion: Bob Mommaerts, Director of Public Services, Kale Proksch, Park & Recreation Director; Dennis Steigenberger, Project Manager from Foth; Also present representing the Harbor Commission: Ken Hayes, Chairperson and members: Wm. Pries and Ellis Mercier; Wittkopf questioned where will the funds come from; Belongia provided information on the State Trust Fund loan program; can borrow up to $500,000 over a 5 year loan at 3.5%; Maas Chairperson of Finance stated this was discussed at the finance meeting and 3.5% is a very good rate; Belongia checked with local financial institutions and the state program had the best rate; Hayes gave history of use by boaters of the breakwater park marina, down last year due to our construction of the new bathroom/shower facility and with the economy; anticipate the additional slips this project will put in, we can increase our revenue; Jim Stiloski referenced three or so years ago, the marina slips being full; Maas stated this project is the second phase of what we envisioned for improvements at our harbor; Maas stated if we don’t do this project know and take advantage of the $1,416,000 grant, we received…if we don’t fund for our share, we loose the grant; Jim Stiloski asked if additional trees and grass areas will be included in the project; Proksch stated yes; Wittkopf questioned if fishing piers will be part of the project; Hayes explained the project, phase 1 and phase 2; Jim Stiloski stated this is a good thing for our tourism; Mayor referenced grant, can’t change the scope of the project now that we’ve been awarded the grant; Wittkopf stated he’s not against the project, just borrowing an extra $500,000; Mayor stated we must move forward with the bid as let;

Moved by Wittkopf seconded by Fulton to authorize the borrowing of a loan through the State Trust Fund program for $500,000.00 to meet
our share of the project costs for the Breakwater Park Marina project.

7. Discussion on recommendation from Finance Committee for Contract A- 09; Hayes went over scope of project; at the finance meeting earlier this
evening they amended the motion from Harbor Commission to put back
into the project a 6 ft wide pier with stairs along the river side of
Peninsula and a 48’ x 6’ gangway with rails that is handicap accessible;
these items by Harbor Commission were discussed but felt to help bring
costs down could be added at in the future; these two items were over
$107,000; Discussion; council visually viewed the plans for the project;

Moved by Doeren seconded by Maas to accept recommendation from the Finance Committee and award the Breakwater Park Marina Construction
Phase 1 and Phase 2 project to McMullen & Pitz Construction for their low
bid of $2,456,825 and approve of Change Order # 1 for a deduct of
$402,390.47 for a contract price incorporating the change order to
$2,054,434.93.

8. Mayor briefed the council on the resolution before us to correct a conflict with a warranty deed dated 9/10/2002 for airport property; as the airport is jointly owned by Oconto County and the City of Oconto both entities have
to approve of the Resolution correcting the deed from Steven C. Rudolph and Linda L. Rudolph.

Moved by Wittkopf seconded by Doeren to approve of the Resolution correcting conflict with a warranty deed dated 9/10/2002 for airport
property.
Motion carried upon electronically recorded vote. 9 ayes 1 absent

9. Mayor stated at the 1/5/2010 Com of the Whole meeting a closed session was held and when we reconvened into open session the council doors
were not physically opened in case anyone wanted to come in; so to avoid
any possible voting error that may have occurred regarding the motion
made on the improvements to the property owned by Randy Cain, 710 5th
Street, Oconto, WI we will vote on those issues again.

10. Moved by Wittkopf seconded by Maas to move forward with levying the
assessments on the property owned by Randy Cain at 710 Fifth Street,
Oconto, WI.

11. Moved by Wittkopf seconded by Joe Stiloski to approve of the Preliminary Resolution for parcel # 265-32-200662078, physical address 710 Fifth
Street, Oconto, WI owned by Randy Cain.
Motion carried upon electronically recorded vote.
8 ayes 1 abstaining – Young and 1 absent – Zahn

12. Moved by Schreiber seconded by Wittkopf to adjourn.
