Tuesday, February 10th 2009

AGENDA
These will be open meetings and notice has been given to the public at least twenty-four (24) hours prior to the meeting by forwarding the complete agenda to the Oconto County Reporter. Copies of the agenda were available for inspection at the office of Clerk/Treasurer and on the City’s website calendar: www.cityofoconto.com

4:00 p.m. Plan Commission meeting will be held in Council Chambers for the following: (Members are: Donald H. Nerenhausen,
Robert Mommaerts, Kale Proksch, Jim Lacourciere, Bob Bake, John Matravers and Mike Werner)

1. Meeting called to order
2. Roll call
3. Approval of agenda
4. Correspondence/public input
5. Discussion/recommendation on CSM’S for:
a. Patricia DeWitt

b. Scott Stewart, etc

c. Zion Lutheran Church

d. Possible abandonment of Bar-Nik Rd East & West from a point 33’ W of the East lien of Gov’t Lot 6 to the intersection
with the S ROW line of McDonald Street. This will be subject to
approval of access to Outlot 1 by the Airport Commission.

e. Draft amendment to the Subdivision Technical Requirements
Ordinance.

8. Action on possible suspension of the rules regarding the adoption
of ordinances.

9. Approval of Consent Agenda:

a. Approve of Draft ordinance for ATV’s except for eliminating under “g” (j) and/or brake lights.

b. Approve of proposal from DMK, Inc. for crushing at $4.03/cu
yd/$3.10/ton.

c. Amending Ord Sec 6-4-6 regarding Planting of trees.

d. Amending Ord Sec 2-3-5 regarding the Director of Public Services.

e. Approval of City of Oconto on billboard sign as requested by Jones Sign at no costs to the city.

f. Approve of Resolution Providing for the Sale Not To Exceed $5,430,000 Waterworks and Sewerage System Revenue Bond
Anticipation Notes.

g. Approve of writing off uncollectible special assessments for 212 Turner Avenue and 1429 Main Street as these lots were
sold by the County at a loss.

h. Approve of listing of accts payables for $413,677.67; payroll for $168,776.14; and financial reports as presented.

i. Approve of applications for an operators license and Temp
Class B.

j. Accept recommendation on RLF # 08-01 and RLF # 05-02.

10. Discussion/action on:

a. Recommendation from Plan Commission on CSM’S for
a. Patricia DeWitt
b. Scott Stewart, etc
c. Zion Lutheran Church

d. Amendment to Ord regarding subdivision Technical Requirements.

11. Council may vote to convene into Closed Session at approximately 7:00 p.m. as allowed by Wis. Stats. 19.85(1) (g)
to allow for discussion with legal counsel regarding strategy on
litigation regarding Barley Excavating Claim and B.M.H.C.

12. Council may vote to reconvene into Open Session at
approximately 7:30 p.m. pursuant to notice duly given and as
allowed by Wis. Stats. 19.85(2)

13. Possible action on litigation regarding Barley Excavating Claim and B.M.H.C.

14. Action on recommendation from Wage & Personnel that the probationary period should end on 2/10/09 for Robert J.
Mommaerts and that he be hired as the full time Director of
Public Services at established hourly rate; for 30 hrs per week
and with residency required by 9/30/09 with a signed statement
from Mr. Mommaerts that he will be a City of Oconto resident
by 9/30/09.

15. Next Com of the Whole meeting 3/3/09.

16. Adjourn.
