Minutes of the Wage & Personnel meeting held on Tuesday, February 23rd, 2010 pursuant to notice duly given.

1. Meeting called to order by Chairperson Schreiber at 4:45 p.m.
2. Roll call: Al Schreiber, Jack Maas, Marlene Zahn, Jim Stiloski and John Wittkopf. Also present: Advisory members Ron Hayes and Dave Rosenfeldt; Mayor Nerenhausen and Linda M. Belongia Administrator and as recording secretary.
3. Moved by Maas seconded by Zahn to approve of the agenda as presented.
4. No correspondence or public input.
5. Chairperson Schreiber stated the committee may vote to convene into Closed Session pursuant to notice duly given and as allowed by Wis. Stats. 19.85[1] [b] for interviews and discussion on the position of Director of Public Service.
Moved by Wittkopf seconded by Stiloski to convene into Closed Session at 4:47 p.m.
Motion carried upon verbal roll call vote. 5 ayes

Advisory members Hayes and Rosenfeldt included in the closed session

Closed Session

4:53 p.m. Robert J. Mommaerts, P.E. interviewed

5:07 p.m. Patrick Geisendorfer, P.E. interviewed

6. Moved by Stiloski seconded by Wittkopf to reconvene into Open Session at 5:45 p.m.
Motion carried upon verbal voice vote. 5 ayes

7. Discussion on position of Director of Public Service (DPS); residency has to be decided…verification on residency of Mommaerts as he is running for alderperson; Belongia stated Atty. Mraz gave opinion that residency was met allowing Mommaerts to run for office; Maas stated he is not satisfied with this opinion; Stiloski stated we should re-advertise; Maas stated we need to look at our ordinance for this position, has caused us problems in the past, may need to amend and delete that this position be a licensed engineer…that would open up more applicants and we then could contract out for engineering needs;
Further discussion on residency;

Moved by Stiloski to recommend we re-advertise.
Chairperson called three times for a second. Motion failed for lack of second.

Moved by Wittkopf to recommend to Com of the Whole to offer the full-time position of DPS to Robert J. Mommaerts, P.E. contingent that he physically move into the city within six months.
Motion carried upon verbal voice vote.
3 ayes: Wittkopf, Maas and Schreiber. 2 no: Zahn and Stiloski

8. Discussion on residency for seasonal employees as referred back by action taken at the 2/9/2010 council meeting.
Stiloski stated have to hire residents; can’t believe after looking at listing of our seasonal employees we have are 50% living outside the city;

Moved by Stiloski seconded by Zahn to recommend that an ordinance be created that starting 1/1/2011 all seasonal employees be city residents.

Maas referenced minutes stating Park & Rec director has difficulties hiring lifeguards;

Stiloski stated lifeguard classes are now being offered as a class, students can get ˝ a credit;

Wittkopf stated there is an ad in today’s paper that the Bond Center is also offering classes.

Motion carried upon verbal vote. 5 ayes

9. Discussion on City Attorney position. Stiloski stated after the discussion at the February council meeting, we need to get something in place as Atty. Mraz will be done May 1st; Belongia reported that the Mayor received a letter from Atty. Kalny our labor attorney who expressed interested in helping fulfill our municipal attorney needs; Belongia also stated Atty. Pat Judge called and will be sending a letter also interested in this position; Discussion on different areas we need legal advice; municipal issues; labor issues; assistance when creating TID districts; financial advice from bond counsel; would need to change our charter ordinance to make the city attorney position contracted versus elected; Stiloski suggested we talk to Atty. Kalny; Wittkopf stated we should see if any of our local attorneys are interested.

Moved by Maas seconded by Stiloski to put this on the next W&P agenda we will have in March and have Atty. Kalny discuss his offer of services and what his fee would be.
Motion carried upon verbal voice vote. 3 ayes 2 no: Zahn and Wittkopf.
