Plan Commission Minutes from 2/10/09 Meeting

Minutes of the Plan Commission meeting held on Tuesday, February 10th, 2009 at city hall pursuant to notice duly given.

1. Meeting called to order at 4:10 p.m. by Chairperson Mayor Nerenhausen.
2. Roll Call: Mayor Nerenhausen, Kale Proksch, Bob Bake, Mike Werner and Jim Lacourciere. Excused/absent: Bob Mommaerts and John Matravers
Linda Belongia, Administrator and as recording secretary also present.
3. Moved by Lacourciere seconded by Bake to approve of the agenda as presented.
4. No correspondence or public input
5. Discussion/recommendation on:
Mayor Nerenhausen turned the meeting over to Kale Proksch as Acting Chairperson:
a. Discussion on CSM for Patricia DeWitt; Donald Nerenhausen as surveyor stated this CSM was done to combine two existing lots…property owner can’t get benefits to assist with heating costs, etc., as the adjoining lot is considered as ownership for the property owner;
Belongia stated the CSM was sent over to the Zoning office for review as well as review by the city Director of Public Service and Bldg Inspector…all comments and errors have been corrected.
Moved by Bake seconded by Werner to recommend to Council approval of the CSM for Patricia DeWitt.
Motion carried upon verbal voice vote.
4 ayes 2 absent: Mommaerts and Matravers and 1 abstaining: Nerenhausen

b. Discussion on CSM for Scott Stewart, etc. Mr. Nerenhausen stated this CSM separates two lots, the homestead property owned by Scott Stewart which he is going to sell; the newly created Easterly lot will be purchased by the father;
Belongia stated the CSM was sent over to the Zoning office for review as well as review by the city Director of Public Service and Bldg Inspector…all comments and errors have been corrected.
Moved by Werner seconded by Lacourciere to recommend to Council approval of the CSM for Scott Stewart, etc.
Motion carried upon verbal voice vote.
4 ayes 2 absent: Mommaerts and Matravers and 1 abstaining: Nerenhausen

c. Discussion on CSM for Zion Lutheran Church; Mr. Nerenhausen stated that the church owns a large lot; they want to separate the property by this CSM and sell off one lot…which would be North of the church property;
Belongia stated the CSM was sent over to the Zoning office for review as well as review by the city Director of Public Service and Bldg Inspector…all comments and errors have been corrected.
Moved by Lacourciere seconded by Bake to recommend to Council approval of the CSM for the Zion Lutheran Church.
Motion carried upon verbal voice vote.
4 ayes 2 absent: Mommaerts and Matravers and 1 abstaining: Nerenhausen

e. Mayor stated the draft ordinance amending the Subdivision Technical
Requirements ordinance amends our ordinance that addresses will not
longer have to be shown on the CSM; county doesn’t require this; zoning can change…shouldn’t be required on CSM;
Moved by Lacourciere seconded by Werner to recommend amendment to the ordinance for Subdivision Technical requirements.
Motion carried upon verbal voice vote.
5 ayes 2 absent: Mommaerts and Matravers.

d. Discussion on abandonment of Bar-Nik Road East & West from a point 33’ West of the East Line of Gov’t Lot 6 to the intersection with the S ROW line of McDonald Street; This will be subject to approval of access to Out lot 1 by the Airport Commission.
Mayor stated the property owners along the backside…Airport on front and Bar-Nik Rd on back…. problem is Outlot…we cannot land lock that Outlot; Mayor stated if Airport Commission deeded over that portion…to allow access…. but after meeting with airport commission they can’t, so until such time as we can find another solution…issue should be tabled and no action taken at this time; Bake suggested abandoning portion of road; Mayor stated he will talk to the property owners;
Moved by Bake seconded by Lacourciere to table abandoning the property at this time.
Motion carried upon verbal voice vote.
