Minutes of the Committee of the Whole meeting held on Tuesday, October 5th, 2010 at city hall pursuant to notice duly given.

1. Meeting called to order at 5:26 p.m. by Mayor Fulton.
2. Roll call: Mayor Fulton, Ed Young, Roger Reed, John Wittkopf, Al Schreiber, Joe Stiloski, Marlene Zahn, Dick Doeren, Terri Berth, Jim Stiloski, Jack Maas and Atty. Mraz. Also present: Jack Mlnarik Fire Chief and Linda Belongia Administrator and as recording secretary.
3. Moved by Schreiber seconded by Wittkopf to approve of the agenda as presented.
Motion carried upon verbal voice vote. 10 ayes
4. Public appearances/correspondence: Complaint about our law enforcement department not enforcing ordinance regarding semi parking on city streets; League Letter; Updated committee listing and minutes from previous months meetings;
5. Discussion/recommendation on:
a. Moved by Maas seconded by Doeren to accept recommendation from Finance and recommend Council approval of final pay request for United Construction for OC-10-D, curb & gutter and sidewalk construction for $1,562.70.
Motion carried upon electronically recorded vote. 9 ayes 1 no Jim Stiloski
b. Moved by Wittkopf seconded by Reed to accept recommendation from Finance and recommend Council approval of Contract OC-10-E sidewalk construction on southeast side not to exceed budgeted amount of $57,591.
Motion carried upon electronically recorded vote.
8 ayes and 2 no: Joe Stiloski and Jim Stiloski
c. Discussion on recommendation from Finance to approve of transferring $20,000 from the Industrial Development Commission (IDC) to the Tourism budget for fishing tournaments.
Mayor stated we need to make the tournaments a community wide project; feel confident our investment of $40,000 will give our city much exposure; these are two national and international tournaments; we also have seven other tournaments scheduled for next year;
Moved by Doeren seconded by Berth to accept recommendation from Finance and recommend to Council approval of the transfer of $20,000 from the IDC budget to the Tourism budget for the fishing tournaments.

Discussion: Zahn questioned if any of this will be taxpayer money? Mayor stated yes, working on getting corporate sponsorship; Jim Stiloski questioned where is the $20,000 coming from? Mayor stated the IDC has had a carryover for a few years; Jim Stiloski questioned what is the Chamber of Commerce putting in? Mayor stated yes, they are looking at something like “A Taste of Oconto” for 350 people; Mayor will be sending out letters asking for corporate sponsorship; Jim Stiloski questioned if we received any sponsor money yet? Mayor stated no; Jim Stiloski questioned where will the other $20,000 come from? Mayor stated right now $20,000 is being requested from the IDC budget; Schreiber referenced the $1M issue we just borrowed…if we have a carryover that is not being used, maybe this should go back to the general fund…not against tournaments…but could take the $20,000 to promote for industrial development…need to tighten the purse strings; Schreiber questioned how much did we make on the last tournament we had? Doeren stated we took this tournament on ourselves for the first time…weather was not good…; the FLW company runs 189 tournaments per year; is a world class deal; we just approved spending $57,000 to tear our sidewalks, what is that going to do for us…Doeren referenced he is working with the Radisson in Green Bay for rooms and being one of the sponsors; Zahn stated we’re getting to big too fast; Mayor stated we will have a $4.5M investment on our marina project, end result when completed will be a major investment…that work started in 2003-04…referenced the Sporting Complex…all teams coming here for the Lt League tournament…NEW North comments have been you can take out ad’s but something like the tournaments, spending $40,000 is a lot of money, but we need to take a shot at this…this council did a lot of things and made them happen…the return on this $40,000 means we have a healthy business environment…strongly urges council to move forward on this; Wittkopf questioned what if we only get this $20,000? Mayor stated then we will only go with the FLW tournament; Young stated a lot of discussion has been had on this…stated he’s not against the tournaments, but we should wait till after our finance budget meeting this Friday, let Finance review and discuss this;

Moved by Young seconded by Reed to amend the motion to send the recommendation to approve of transferring $20,000 from the Industrial Development Commission (IDC) to the Tourism budget for fishing tournaments to the 10/8/2010 Finance meeting.

Motion carried upon electronically recorded vote. 7 ayes 3 no: Zahn, Berth and Maas

d. Moved by Wittkopf seconded by Schreiber accept recommendation from Finance and recommend to Council approval of the listing of accts payables for $476,473.39; payroll for $127,694.57; and financial reports as presented.
Motion carried upon electronically recorded vote. 10 ayes

e. Moved by Wittkopf seconded by Maas to accept recommendation from BPW and approve of closing Park Avenue from Main Street to Madison Street and Main Street from Park Avenue to Erie Avenue on Saturday, December 11th, 2010.
Discussion: Jim Stiloski questioned what time is the parade….does this mean these streets will be closed for the entire day?
Belongia will get more information and have this on the October Council agenda for action.
Motion withdrawn by Wittkopf and Maas.

f. Moved by Wittkopf seconded by Schreiber to accept recommendation from BPW and recommend to Council approval of the tentative agreement with the Town of Lt. River for 0.5 miles of Old Highway 41 from north city limits to County Highway S.
Motion carried upon electronically recorded vote. 10 ayes

g. Mayor stated the proposed layout for Evergreen Street/Cook Avenue is for information only.

h. Moved by Wittkopf seconded by Schreiber to accept recommendation from Plan Commission and recommend to Council approval of the CSM for Thomas Fulton et al.
Motion carried upon electronically recorded vote. 10 ayes

i. Moved by Wittkopf seconded by Zahn to accept recommendation from Plan Commission and recommend to Council approval of the CSM for the City of Oconto.
Motion carried upon electronically recorded vote. 10 ayes

j. Moved by Zahn seconded by Doeren to accept recommendation from Park & Rec and recommend to Council to post for 30 days amendment to ordinance to include Copper Culture North and South trail.
Motion carried upon electronically recorded vote. 9 ayes and 1 no Jim Stiloski

k. Discussion on recommendation from Police & Fire Commission on amendment to ordinance regarding Secured Key Boxes; Jim Stiloski felt fire dept could have been system with keys and not the businesses incur the expense of purchasing the Knox- box; Chief Mlnarik stated the cost is approx $300, provided handout of information;
Mayor commended Chief that he has done due diligence on this matter.
Moved by Maas seconded by Schreiber to accept recommendation from Police & Fire Commission and recommend to Council to post for 30 days amendment to ordinance regarding Secured Key Boxes.
Motion carried upon electronically recorded vote. 9 ayes and 1 no Jim Stiloski

l. Moved by Wittkopf seconded by Schreiber to recommend to Council approval of a Temp Class B license for Holy Trinity Parish for 11/13/2010 and contingent upon completion of the required operators beverage training course an operators license for Curtis Harvey.
Motion carried upon electronically recorded vote. 10 ayes

6. Regular Council meeting, Tues. 10/12/2010.
