Special Council Minutes 10/26/2010

Minutes of the Special Council meeting held on Tuesday, October 26th, 2010 pursuant to notice duly given.

1. Meeting called to order at 5 p.m. by Mayor Fulton.
2. Roll call: Mayor Fulton, Ed Young, Roger Reed, John Wittkopf, Al Schreiber, Joe Stiloski, Marlene Zahn, Dick Doeren, Terri Berth, Jack Maas and Atty. Calvert. Absent: Jim Stiloski. Also present: Jeff Belongia, Hutchinson, Shockey & Erley, Robert Mommaerts, P.E. Director of Public Services and Linda Belongia Administrator and as recording secretary.
3. Invocation and pledge of allegiance given by Alderperson Maas.
4. Moved by Wittkopf seconded by Doeren to approve of the agenda as presented.
Motion carried upon verbal voice vote. 9 ayes
5. No correspondence or public input
6. Mayor stated the Council may vote to convene into Closed Session pursuant to notice duly given and as allowed by Wis. Stats. 19.85(1)(e) for the following:
a. Recommendation from Redevelopment Authority on #2010-01.
b. Offer(s) to purchase.
c. Developer(s) agreement.
Moved by Wittkopf seconded by Reed to convene into Closed Session at 5:02 p.m.
Motion carried upon verbal roll call vote. 9 ayes 1 absent: Jim Stiloski

Also included in the Closed Session: Jeff Belongia and Robert Mommaerts.

Closed Session

7. Moved by Maas seconded by Zahn to reconvene into Open Session at 6:10 p.m.
Motion carried upon verbal voice vote. 9 ayes 1 absent

8. Moved by Wittkopf seconded by Reed to accept recommendation from the Redevelopment Authority and approve of a loan to RDA # 2010-01.
Motion carried upon electronically recorded vote.
8 ayes 1 abstaining – Joe Stiloski and 1 absent – Jim Stiloski

9. Moved by Maas seconded by Wittkopf to accept the Option to Purchase and Offer to Purchase from The Gregory Company, LLC., and the Amended Offer to Purchase from Keystone Development, LLC and/or Assigns.
Motion carried upon electronically recorded vote.
8 ayes 1 no – Joe Stiloski and 1 absent – Jim Stiloski

10. Moved by Maas seconded by Doeren to approve of the Developer’s Agreement for Bayside Senior Apartments, LLC.
Motion carried upon electronically recorded vote.
8 ayes 1 no – Joe Stiloski and 1 absent – Jim Stiloski

11 & 12. Discussion on draft smoking ordinance which has been posted since 9/17/2010. Atty. Calvert
presented some additional language regarding enclosed smoking area. Discussion.
Moved by Zahn seconded by Wittkopf to adopt under suspension of the rules and as amended by Atty. Calvert the ordinance repealing and recreating the Municipal Code of Ordinances of the City of Oconto regarding Regulation of Smoking.
Motion carried upon electronically recorded vote. 9 ayes and 1 absent – Jim Stiloski

13. Mayor stated the Committee of the Whole will meet on Monday, November 1st, 2010 at 5 p.m. and included on that agenda will be discussion/review of the proposed 2011 budget.

14. Moved by Maas seconded by Wittkopf to delete having a Committee of the Whole meeting on Thursday, November 4th and any agenda items can be placed on the November 1st, meeting.

15. Moved by Zahn seconded by Wittkopf to adjourn. M/C
