Minutes of the Community Enrichment meeting held on Friday, March 18th, 2011 at 10:00 a.m. pursuant to notice duly given.
1. Chairperson Maas called the meeting order at to order at 10:04 a.m.
2. Roll call: Jack Maas seconded by Al Schreiber, Jack Mlnarik and Ron Banach. Absent: Dale Carper. Also present: Mayor Fulton, Atty. Calvert, Atty. Burke, John and Carol Wittkopf, Mark Kohlmann and Suzanne Schwanz.
3. Moved by Schreiber seconded by Mlnarik to approve of the agenda as presented.
Motion carried upon verbal voice vote. 4 ayes
4. Correspondence/public input: John Wittkopf addressed the chair on when the public could speak? Maas stated he will allow Wittkopf to speak during the discussion.
5. Maas stated at the last meeting under correspondence discussion was had and a motion that was not listed on the agenda;
Moved by Schreiber seconded by Mlnarik to amend the minutes from the 3/7/2011 Community Enrichment Minutes and remove the discussion and motion regarding 171 Mott Street as it was not listed on the agenda.
Motion carried upon verbal voice vote. 4 ayes
6. Discussion/possible action/recommendation on 171 Mott Street. Atty. Calvert handed out a timeline for 171 Mott Street; Calvert stated as of 3/11/2011 the permit expired; Schreiber stated at previous meeting motion should not have been made; Atty. Calvert stated they are looking for a new building permit; Schreiber referenced stipulation time; razing order….should had had a timeline and razing order before today; Mayor stated 171 Mott Street has been discussed numerous times, appreciates our city attorney establishing the timeline; called for steel roof…that hasn’t been done…Banach went through with Police & Fire Chief; Schreiber stated we as a committee have other properties; Mlnarik stated as committee members, we know what we are here for; Atty. Burke referenced April 2010 – Schoen’s and Wittkopf; razing order, no citation can be done within 90 days if we come with razing order…referenced house on Main Street, we are asking with weather better, within 60 days; Atty. Calvert stated the timeline was agreed upon by both attorney’s; Wittkopf stated as a taxpayers he has lived next to this property for approx eight years…has kept going over to shut the door to keep animals out….referenced steel roof; Atty. Burke stated Wittkopf nor his wife made no reference as taxpayers; Banach stated as the bldg inspector he can revoke a building permit at anytime; Wittkopf referenced municipal code; Atty. Calvert stated if Banach received a call for the permit he’d receive a denial;
Moved by Banach seconded by Mlnarik that the revocation of the bldg permit and the razing order remain in tack.
Discussion. Mlnarik stated the timeline was established, had ample time for property owner to bring to compliance with city; Maas stated we would not be here because we have to remove property from tax roll; Schreiber stated property owner should have been quicker for explanation…timeline was in place…agree with Wittkopf; Atty. Calvert stated Mr. Kohlmann until stipulation has no control;
Motion on vote. 2 ayes Mlnarik and Banach; 2 no: Maas and Schreiber.
Motion denied.
Moved by Maas seconded by Schreiber to issue a new 60 day permit and if we end at that, on the 61st days a razing order will be issued.
Discussion. Schreiber qualified – 60 days; Banach stated he will issue permit per stipulation order; Atty. Calvert stated the first part – 90 days; 2nd part – razing order; 3rd par- we don’t want an eyesore;
Vote on motion.
2 no: Maas seconded by Schreiber; 2 ayes: Mlnarik and Banach.
Motion denied.
7. Next meeting, Monday, March 28th, 2011 at 8:30 a.m.
