Minutes of the Special Council meeting held on Tuesday, June 2nd, 2009 at city hall pursuant to notice duly given.
1. Meeting called to order at 6:45 p.m. by Mayor Nerenhausen.
2. Roll call: Mayor Nerenhausen, Ed Young, Lloyd Heier, John Wittkopf, Al Schreiber, Joe Stiloski, Marlene Zahn, Dick Doeren, Tom Fulton, Jim Stiloski, Jack Maas and Atty. Mraz. Linda Belongia, Administrator also present as the recording secretary.
3. Invocation and pledge of allegiance by Alderperson Zahn.
4. Moved by Maas seconded by Doeren to accept the recommendation from the Com of the Whole and approve of the proposal from UP Engineers and Architects to do six soil boring tests and provide a report on the results for the property at 235 Cook Avenue, Oconto, WI at a cost not to exceed $4,800.
Motion carried upon verbal voice vote. 10 ayes
5. Moved by Zahn seconded by Doeren to accept recommendation from Com of the Whole and approve of the offer to purchase from Keystone
Development for a parcel located in the NW corner of the property at 235
Cook Avenue, 275’ x 237’.
Motion carried upon verbal roll call vote.

6. Moved by Doeren seconded by Heier to accept recommendation from Com of the Whole to schedule the public hearing to change the zoning for
the proposed TID No. 4 area from IG General Industrial to CH Highway
Commercial.
Motion carried upon verbal voice vote. 10 ayes
7. Moved by Maas seconded by Doeren to accept recommendation from Com of the Whole and approve of the proposal from Quarles & Brady for
legal services on creating TID No. 4.
Motion carried upon verbal voice vote. 9 ayes 1 no – Joe Stiloski
8. Moved by Wittkopf seconded by Heier to accept recommendation from Com of the Whole and adopt the Preliminary Resolution for Michigan
Avenue and schedule the public hearing.
Motion carried upon verbal voice vote. 10 ayes
9. Discussion on the Ed Young/Randy Cain charges for lot, parcel # 265-32- 200662078. Mayor stated the mains are to the property line; Atty. Mraz
stated the city levied assessments against the lots in that subdivision,
waivers were signed for those lots, but not for the Young/Cain property,
recommends going back starting the process to levy the special
assessments; Maas stated this is between the Young’s and Cain;
Wittkopf agreed with attorney, go back and levy the assessments through
the process; Zahn stated if it’s a city mistake it should be absorbed; Young
stated in 2003 – or 04 city attorney gave an opinion that he didn’t have
access; Mayor referenced a developer came in and original assessment
was for thirteen lots; then Young wanted access and the developer
granted that; Maas questioned where do we go from here? Atty. Mraz
stated it is a difficult issue…and Young is a member of Finance;
Moved by Wittkopf seconded by Heier to proceed with the process to levy the special assessments as recommended by Atty. Mraz.
Motion carried upon verbal roll call vote.
6 ayes: Heier, Wittkopf, Joe Stiloski, Fulton, Jim Stiloski and Maas.
3 no: Schreiber, Zahn and Doeren. 1 abstaining: Young
10. Moved by Wittkopf seconded by Schreiber to adjourn. M/C
