Bd of Appeals Minutes

Minutes of the Board of Appeals Public Hearing and Meeting held on Tuesday, May 5th, 2009 pursuant to notice duly given.


Chairperson Exworthy opened the public hearing at 4:10 p.m. on the request from Gerald and LaVonne Brown, 209 Mott Street, Oconto, WI for a variance from Section 13-1-200 (1) Accessory Building Number Limits. In any residential district, in addition to the principal building, a detached garage or attached garage and one (1) additional accessory building may be placed on a lot.

Ron Banach, Building Inspector stated they have an attached garage and an existing storage building and are requesting a 2nd storage building;

Exworthy questioned if they have one or two lots;

LaVonne Brown stated their number one priority for the accessory garage is they would like to improve their property…and with the new highway going by; number two is they want a storage area for their boat & trailer, riding lawn mower and camper and 2nd car which their daughter is currently using; the wood shed they have no longer is necessary as they are not burning wood; other bldg is a garden shed for the garden tools and their bikes;

Belongia read into the record the letters from adjacent property owners Tom Belongia and Jim Kempfer and Loralee Lasley all having no objection to the request.

Pecor asked how long the Brown’s had the wood shed on their property.

Gerald Brown stated 20 years +; LaVonne stated it could be 30 years;

Exworthy questioned what the size of the lot is;

Gerald stated approx 168’…;

Pries stated approx 2 ½ acres;

Exworthy stated the Brown’s intent is to have just one driveway off of Mott
Street; garage will be 30 x 30 with a cement slab;

Gerald Brown stated it will be a poll garage;

Exworthy stated as beautiful as the Brown’s property is, this will all fit in;

LaVonne stated the roof will be burgundy and walls white;

Exworthy closed the public hearing at 4:20 p.m.

1. Meeting called to order at 4:20 p.m. by Chairperson Exworthy.
2. Roll call: Sue Exworthy, Ron Hayes, Ken Hayes, Mike Pecor and Wm. Pries.
3. Moved by R Hayes seconded by Pecor to approve of the agenda as
presented.
Motion carried upon verbal voice vote. 5 ayes

4. No additional correspondence or public input.
5. Deliberation and decision by the Board of Appeals on request from Gerald
and LaVonne Brown, 209 Mott Street, Oconto, WI. for a variance to the
Municipal Code of Ordinances, Section 13-1-200(1).

Exworthy stated the board needs to decide if this is an area or use variance;
Exworthy stated she feels it should be an area variance with the Brown’s lot
our ordinance is a hardship to them; to their situation and to their lot; they
have a very country setting;

R Hayes agreed, our ordinance puts a burden on them;

Pecor stated the wood shed should be grandfathered in;

Exworthy stated they are changing the size of the structure that is currently
their shed;

R Hayes stated we should discount the other building where the bikes are
stored;

R Hayes stated we have no complaints from the surrounding neighbors;
Garage will be for private use; some children’s play houses or dog houses
are bigger;

Moved by R Hayes seconded by Pecor to approve of the request in full for a
variance to the Municipal Code of Ordinances, Section 13-1-200 (h).
Motion carried upon verbal voice vote. 5 ayes

Exworthy read aloud the Findings of Fact, Conclusions of Law and the Order and Determination to Gerald and LaVonne Brown.

6. Moved by K Hayes seconded by R Hayes to adjourn. M/C
