Mts Bd of Appeals

Minutes of the Board of Appeals Public Hearing & meeting held on Tuesday, March 30th, 2010 at city hall pursuant to notice duly given.

Public Hearing opened at 4:38 p.m. by Chairperson Exworthy for the request from Jim and Stacy Koch, for property they own at 2111 Superior Avenue, Oconto, WI for a variance from Section 13-1-200(3)a which states all buildings exceeding twenty feet in height will require a variance.

Ron Banach, Bldg Inspector stated the request is to build a garage and storage above with a height of 22’ from the peak…has viewed the site…per ordinance any accessory building over 20’ requires a variance.

Jim Koch stated they would like to build a storage building for their camper and seasonal storage items; too wet to put anything in their basement; want the new bldg to have a barn look to more aesthetically appealing to their property;

Belongia stated she received no phone calls or correspondence on this request.

Exworthy, hearing no further questions from the Bd of Appeals closed the hearing at 4:41 p.m.

1. Meeting called to order at 4:42 p.m. by Chairperson Exworthy.
2. Roll call: Sue Exworthy, Ron Hayes, Ken Hayes, Dick Doeren, and Mike Pecor.
Also present: Mayor Nerenhausen, Jim and Stacy Koch, Ron Banach and Linda Belongia Administrator and as recording secretary.
3. Moved by R Hayes seconded by Doeren to approve of the agenda as presented.
Motion carried upon verbal voice vote. 5 ayes
4. No correspondence or public input.
5. Deliberation and decision by the Board of Appeals on request from Jim and Stacy Koch, for property they own at 2111 Superior Avenue, Oconto, WI for a variance
from Section 13-1-200 (3)a which states all buildings exceeding twenty feet in
height will require a variance.
Discussion: R Hayes questioned when will the construction start for this bldg? J Koch stated this will be built through the building class at the high school and
they are ready to start immediately…walls will be constructed at the school and
then put in place on the property; R Hayes stated if the variance is granted there
is a 30 day window for appeal…if the property owners start before the 30 days
have expired, you would be on your own; uniqueness of the property…low
property and water standing; J Koch stated they own 29 acres total consisting of
three different parcels; their home is on one of these parcels with 4 acres;
Exworthy stated it is unique for property of that size in the City of Oconto; R Hayes questioned 13-1-200 3(a) as the proposed bldg Koch’s want to build will
be detached; Exworthy referenced the last sentence of that section of the
ordinance; Pecor stated they have the land space, but with the ordinance, they
have physical limitations with the height they need for their camper; Exworthy stated where the Koch’s are proposing to build is a high spot; R Hayes questioned
where are the wetlands on their property? Banach stated the other parcel that is
further back; Pecor stated with the height they need, should grant variance.
Moved by R Hayes seconded by Doeren to approve of the variance as requested to Jim and Stacy Koch with no conditions attached.
Motion carried upon verbal voice vote. 5 ayes

6. Moved by K Hayes seconded by Doeren to adjourn. M/C
