Minutes of the Special Council meeting held on Tuesday, January 6th, 2009 at city hall pursuant to notice duly given.
1. Meeting called to order at 6:30 p.m. by Mayor Nerenhausen.
2. Roll call: Mayor Nerenhausen, Lloyd Heier, John Wittkopf, Al Schreiber, Joe Stiloski, Marlene Zahn, Dick Doeren, Jim Lacourciere, Sue Exworthy, Jack Maas and Atty. Mraz. Excused: Ed Young. Linda Belongia, Administrator, also present as recording secretary.
3. Invocation and pledge of allegiance given by Alderperson Heier.
4. Moved by Zahn seconded by Doeren to approve of the agenda and addendum as presented.
Motion carried upon verbal voice vote. 9 ayes
5. No correspondence or public input.
6. Mayor stated the Council may vote to convene into Closed Session pursuant to notice duly given and as allowed by Wis. Stats. 19.85(1) (c), (e) and (g) for the following:
a. Change orders as requested by Champion regarding the demolition of the former Kelly Pickle property;
b. Update on the Barley Claim.
c. Considering employment and performance of Robert J. Mommaerts as the Temporary Director of Public Works.
Moved by Exworthy seconded by Wittkopf to convene into Closed Session at 6:30 p.m.
Motion carried upon verbal roll call vote. 9 ayes

7. Moved by Heier seconded by Wittkopf to reconvene into Open Session at 7:50 p.m.
Motion carried upon verbal voice vote. 9 ayes
8. Moved by Maas seconded by Doeren to reject Change Order # 1 stating that the roof/ceiling items were discussed by Ayres as our engineers at the pre-bid meeting, this was a known and part of the contract work; Change Order # 2 was also rejected and authorizes Ayres Associates to notify Champion to backfill in the basement and leave the walls.
Motion carried upon verbal voice vote. 9 ayes
9. Moved by Maas seconded by Exworthy to allow Robert J. Mommaerts to remain in the capacity as Temporary Director of Public Services until 9/30/09 at which time the services of Mr. Mommaerts will terminate with the understanding that the City of Oconto will be advertising for a full time Director of Public Services with residency required.
Motion carried upon verbal voice vote. 9 ayes
10. Reminder of the Public Hearings scheduled for 1/13/2009 at 5:30 p.m. for a zoning change on the property formerly known as the Kelly Pickle and the adjoining Jerome Brezinski property; also on this agenda will be consideration of amending the CH Commercial Highway zoned districts to allow multi-unit senior apartments and all permitted uses and conditional uses that are allowed under a CH Downtown Commercial Zoned District. Following the public hearings will be the Regular Council Meeting.
