Minutes of the Wage & Personnel meeting held on Thursday, February 10th, 2011 at city hall pursuant to notice duly given.
1. Meeting called to order at 4 p.m. by Chairperson Schreiber.
2. Roll Call: Al Schreiber, Jack Maas, Marlene Zahn, Jim Stiloski and John Wittkopf. Mayor Fulton and Linda Belongia Administrator as recording secretary.
3. Moved by Maas seconded by Zahn to approve of the agenda as presented.
Motion carried upon verbal voice vote. 5 ayes
4. No correspondence or public input.
5. Moved by Jim Stiloski seconded by Zahn to approve and place on file as typed the minutes from the 1/6/2011 meeting.
Motion carried upon verbal voice vote. 5 ayes
6. Chairperson Schreiber stated the committee may vote to convene into Closed Session pursuant to notice duly given and as allowed by Wis. Stats. 19.85(1), (c), (e) & (g) for discussion on the position of Building Inspector.
Moved by Wittkopf seconded by Zahn to convene into Closed Session at 4:02 p.m.
Motion carried upon verbal roll call vote. 5 ayes

7. Moved by Jim Stiloski seconded by Maas to reconvene into Open Session at 4:30 p.m. pursuant to 19.85(2).
Motion carried upon verbal voice vote. 5 ayes
8. Belongia presented draft of table of contents for employee handbook; few changes made to table of contents; Belongia will continue working on this and provide drafts to committee and Atty. Calvert for review;
9. Discussion on draft from Atty. Calvert of Voluntary Leave without pay program. Discussion on items # 10: If a holiday occurs during a Voluntary Leave without Pay, the employee will receive holiday pay and # 13: Once the employee has requested the Voluntary Leave without Pay and it has been approved by the Department Head, the leave cannot be rescinded by the employee unless there is a qualifying event. Once the leave has been taken, there can be no recision.
Discussion. Committee would like Atty. Calvert to re-look at # 10.
Moved by Jim Stiloski seconded by Schreiber to refer the draft Voluntary Leave without pay program back to Atty. Calvert.
Motion denied upon verbal vote. 2 ayes: Jim Stiloski and Schreiber. 3 no: Jack Maas, John Wittkopf and Marlene Zahn.
Moved by Wittkopf seconded by Zahn to refer this to Com of the Whole for more discussion.

10. Discussion on amending ordinance for city attorney position and compensation for this position.
Belongia stated per 1/6/2011 W&P meeting a salary of $25,000 was recommended for the City Atty. position; City could treat this position as an accts payable vendor; the $25,000 would be paid once per month as an accts payable vendor for $2,083.33; our insurance company would require a certificate of insurance naming the City of Oconto as an additional insured for workers compensation purposes; At year end Atty. Calvert would be issued a 1099 tax form and hit would be his responsibility to satisfy requirements of the IRS; This would save the city $4,813.00 in FICA and retirement;
Moved by Zahn seconded by Wittkopf to recommend to Com of the Whole to approve of amending the city attorney ordinance to include the City Attorney shall perform administrative labor issues and such other duties as designated by the Common Council; amend the salary ordinance to reflect that the city attorney be paid as an accts payable vendor and not salary; and that a memorandum of understanding be in place between our city attorney and labor attorney in case Atty. Calvert would need to confer with Atty. Kalny.

11. Discussion on draft job description from Kale Proksch, Park & Recreation Director for a Recreation Intern (Limited Term) which was budgeted for in the 2011 budget.
Jim Stiloski stated he spoke with someone local; clarification on 14 hrs;
Moved by Wittkopf seconded by Maas to recommend the Recreation Intern position to the Com of the Whole.
Motion carried upon verbal voice. 5 ayes
12. Discussion on future agenda items and municipal code defining the Wage & Personnel Committee; all hiring of individuals resumes/applications should be handled through W&P…also doing a background check on all applications. Belongia instructed to have Atty. Calvert review our municipal code section 2-2-5 (f) Duties of Wage & Personnel Committee and section 2-4-3 Wage & Personnel Committee for duties of this committee for opinion on having all hires coming through W&P.
Belongia will continue working on draft of employee handbook;
13. Next meeting will be scheduled as needed per Chairperson Schreiber.
